FAQ

Questions we hear every week

Yes. Foreigners can own a condo unit freehold in their own name, as long as foreign ownership in the building stays within 49% of the total unit area. Funds must be brought into Thailand from abroad in foreign currency, and your bank issues the transfer document the Land Office asks for. We check the quota before you view.

Thai law generally does not allow foreigners to own land in their own name. Common routes are a registered lease (up to 30 years), buying the building separately from the land, or ownership through a Thai spouse under specific rules. We explain each option and work with independent lawyers so you get proper legal advice.

A Chanote (Nor Sor 4 Jor) is the strongest form of land title in Thailand. It is surveyed with GPS boundary markers and allows full ownership, sale and mortgage. We recommend Chanote land for most buyers and always check the deed at the Land Office.

Typical costs are a 2% transfer fee, withholding tax, and either 3.3% specific business tax or 0.5% stamp duty, all based on the official appraised value. Who pays which part is agreed between buyer and seller. We give you an estimate before you make an offer.

Most condos and villas are let on 6 or 12-month contracts, with a two-month deposit and one month’s rent in advance. Some owners accept 1 to 3-month terms at a higher rate.
